get in there unless he had the stocking cap on? the u.s. attorney's office is not opposing the request for the certificate of innocence that he needs for restitution, up to $50,000 for every year locked up. although the judge threw out his conviction, she has remained silent with the court. she said that tribble needs the document. he's jobless and virtually homeless. and&this is a puzzling twist. two other d.c. men who were convicted and exonerated based on hair analysis by the fbi have both received innocence. he's precluded by law from commenting on the pending case. >> we know of three cases where hair analysis is discredited and wrongful convictions in d.c. are there going to be anymore? >> it's possible, brian, and that is because the u.s. attorney's office and the justice department launched an extensive review into the 60s, as we're told, to look at hair analysis cases. back then, the fbi had's view of hair analysis that doesn't work and the dna is proving that and there might be other people sent to prison on hair analysis and that is flawed. >>> the news edge on d.c.

surrounding the attack on the u.s. consulate in benghazi, libya. they are hoping to finally sort out what happened, why there wasn't enough security, who knew about the terrorist ties and whether they knew about that. president obama took on some of those controversies in a wide- ranging press conference yesterday. republicans have been furious about what they see as a changing time line from the white house. ambassador chris stevens and three other americans were coiled trying to defend the post in that ambush. they say u.s. ambassador susan rice gave inaccurate information during her appearances on five sunday talk shows the week after the attack blaming the tax on a video that insulted the prophet mohammed. critics say it was deliberately misleading and they vow to block her nomination should she be nominated as u.s. secretary of state. rice was defended by the president yesterday. >> but for them to go after the u.n. ambassador who had nothing to do with benghazi and was simply mechanicking a presentation based on intelligence that she had received is outrageous. >> a lot of people th

congressional panel investigating the u.s. consulate attacks in benghazi, libya. some lawmakers are questioning the timing. fox's molly henneberg has the latest. >> reporter: now at he's stepped down as cia director, general david petraeus will not testify this upcoming week at house and senate intelligence committee hearings, investigating the benghazi, libya consulate attack. but some on capitol hill are making it clear, they do want to hear from him in the future. >> i hope we don't have to subpoena a four-star general and former cia director. i hope he would come voluntarily. but if he won't, he will be subpoenaed. >> reporter: petraeus, who had been in charge of the cia since september 2011 has previously told lawmakers the attack was in response to a protest over an antimuslim video. we now know that wasn't true. one gop lawmaker is asking questions about the timing of petraeus' departure. >> it comes days before he's set to testify before the house intelligence committee, and it really begs the question of what did the fbi know and when did they know it? how long did they sit

security threats against the u.s. consulate in benghazi. petraeus has been married for 37 years to holly petraeus who he met while a cadet at the u.s. naval academy in west point. he took the helm of the cia in september of 2011. in a statement late this afternoon the president thanked petraeus for his service adding, quote, i have the outmost confidence in acting director michael morel and the men and women who work every day to keep our nation safe. going forward, my thoughts and prays are with dave and holly petraeus who have done so much to help military families that their own work. petraeus took every the cia in september of 2011. of course, the political implications of all of this cannot be overlooked. the obama administration was already under intense scrutiny following the benghazi attack and possible leaks of intelligence information from operations in yemen. new questions now likely are to surface whether or not petraeus' affair may have compromised his position over the last years. >> there is also the issue of the fiscal cliff. both president obama and house speaker j

. he pled guilty for bank fraud charges back in june. fox 5's melanie alnwick is live at the u.s. district court this morning with a look at what brown is facing. >> reporter: good morning. brown is facing perhaps a jail term but we'll see. his original plea agreement where he admitted guilty to all of those charms called identify six-month jail sentence but right now, prosecutors seem to be softening somewhat recommending to the judge just six days in jail for kwame brown and three years of supervised probation. it was really just a high profile fall from grace. brown held the district's second highest local elected office before pleading guilty in june to providing false information on bank loan applications. one of the loans was for a 39- foot, 330-horsepower boat. brown also forged the signature of a friend on an application and doctored two forms to overstate his income by tens of thousands of dollars. another case involved an audit by d.c.'s office of campaign finance and that found that brown's 2008 election campaign failed to report more than $400,000 in contributions and
